The mere fact that the husband or wife ceases to occupy the bed or room in which they have been accustomed to sleep, and thereafter occupies alone another room in the house, is not necessarily a withdrawal of the marital right to have sexual intercourse with the other, so as to constitute an abandonment as a ground for divorce, since the right may continue and be exercised thereafter, under the changed conditions, with the full understanding and approval of both, but it is only where the one leaves the other and continually and unreasonably refuses to have intercourse with the other, that the occupancy of another room and bed constitutes abandonment, within Code, art. 16, § 38, specifying the grounds for divorce. Ruckle v. Ruckle 141 Md. 207, 118 A. 472 Md. (1922).

Maryland Divorce Lawyers

In Hockman v. Hockman, 41 A.2d 510 Md.,(1945) the court stated that (1) Where husband’s misbehavior has been such as to render continuance of marriage relation unbearable, or such as is recognized by law as sufficient to justify wife in leaving him, he is guilty of desertion entitling wife to divorce. Code 1939, art. 16, § 41.(2) If husband’s cruelty is so extreme that it drives his wife away from him, the law presumes that he intended such effect of his cruelty, entitling wife to divorce on ground of cruelty.(3) Public policy requires that a spouse be permitted to set up in defense of his or her separation such misconduct on part of other spouse as would render it impossible to continue matrimonial cohabitation with self-respect, health and safety. (4) Where wife was impelled to lock the door of their apartment because of husband’s unreasonable demands for sexual intercourse without regard for wife’s health, and such action was the only means wife possessed to protect herself, wife was justified in refusing to live with the husband, so that husband was not entitled to divorce on ground of desertion. (5) Nagging, austerity of temper, petulance of manner, rudeness of language and even sallies of passion are not of themselves sufficient to justify separation, as basis for divorce, unless they threaten bodily harm.
