During a quarrel resulting from defendant’s espousing the religion of Dowie, plaintiff, her husband, cursed her and told her that it was a wonder he “did not knock her d______d head off.” Defendant then left him, and, though solicited, refused to return, and later brought suit for limited divorce, after which plaintiff again solicited her to return and treated her affectionately, but, on her refusal to do so, the divorce suit was settled by a contract which provided that, inasmuch as they could not live together, and considering defendant’s ability to support herself, she accepted the sum of $200 in release of all claims to alimony and against plaintiff’s property. Plaintiff testified that after the execution of such paper he solicited her again to go home and live with him, which she refused. Held that, as plaintiff’s conduct in the first instance did not justify defendant’s abandonment, plaintiff was not precluded from obtaining a divorce on the ground because of the separation agreement. Lemmert v. Lemmert 103 Md. 57, 63 A. 380 Md. (1906).
